UTTAM STAY – TENANT TERMS & CONDITIONS
At Uttam Stay, we are committed to creating and maintaining a safe, clean, comfortable and well-managed living environment where every resident can enjoy their stay.
By joining or continuing to stay at any Uttam Stay PG accommodation, every tenant is deemed to have read, understood and agreed to comply with these Terms & Conditions, the applicable Rent/Leave & License Agreement, and any property-specific rules or instructions issued by Uttam Stay.
These Terms & Conditions are applicable in addition to the individual Rent Agreement and are an integral part of the tenant's occupancy terms.
Any breach or violation of these Terms & Conditions may result in warnings, applicable charges, restriction of facilities, termination of occupancy, adjustment/forfeiture of security deposit where applicable, and/or legal action, depending on the nature and seriousness of the violation.
1. OCCUPANCY & USE OF PROPERTY
1.1 Residential Use Only
The accommodation provided by Uttam Stay is strictly for residential occupancy by the approved tenant.
The premises must not be used for any commercial, business, illegal, unauthorised or other purpose not permitted under the applicable agreement.
1.2 No Subletting or Transfer
The tenant shall not sublet, transfer, assign, share or otherwise allow any other person to occupy their allotted bed, room or accommodation without prior written approval from Uttam Stay.
1.3 No Ownership or Independent Property Rights
Occupancy of an Uttam Stay accommodation does not create any ownership, title, permanent tenancy, leasehold or independent property rights in favour of the tenant beyond the rights specifically granted under the applicable Rent/Leave & License Agreement.
1.4 Room/Bed Allocation
Bed and room allocation is subject to availability.
Uttam Stay may change or reallocate a room/bed where reasonably required for operational, maintenance, safety, property-management or other legitimate reasons, subject to the applicable Rent Agreement and applicable law.
1.5 Room/Bed Transfer
Transfer of beds, cupboards, mattresses, appliances or other Uttam Stay assets from one room to another is strictly prohibited without prior approval from Uttam Stay.
2. RENT & PAYMENT
2.1 Rent Payment
Rent shall generally be paid in advance within the first 5 days of every month, unless a different payment date is specifically mentioned in the individual Rent Agreement.
2.2 Payment Method
Rent and other applicable charges shall be paid through the payment method authorised by Uttam Stay, including the RentOk Tenant App, online bank transfer or any other authorised digital payment method.
2.3 Digital Receipts
Payment receipts may be issued digitally through the applicable tenant/payment application.
2.4 Late Payment
Delayed payment may result in reminders, applicable penalties or other action as permitted under the applicable Rent Agreement and Uttam Stay policy.
2.5 Mid-Month Joining
Where a tenant joins during the middle of a month, rent for the applicable period may be calculated on a pro-rata basis and may be included or adjusted through the subsequent rental billing cycle.
3. SECURITY DEPOSIT
3.1 Security Deposit
The applicable security deposit shall be paid as specified in the individual Rent Agreement.
The security deposit shall be interest-free and may be held as security against rent, electricity, utilities, damages, repairs, applicable charges and other obligations of the tenant.
3.2 Deposit Adjustment
At the time of final settlement, Uttam Stay may adjust applicable outstanding amounts, including:
Unpaid rent
Electricity and utility charges
Repair or replacement costs
Damage to property or assets
Lost keys or replacement locks
Applicable contractual charges
Other legitimate dues payable by the tenant
3.3 Deposit Refund
Subject to the applicable Rent Agreement, completion of the required lock-in and notice obligations, clearance of all dues and satisfactory handover, an eligible security deposit refund will generally be processed within 7–15 working days after vacating.
The actual settlement may depend upon pending electricity/utility bills, damages, repairs or other outstanding amounts.
3.4 Early Exit
If a tenant leaves before completion of the applicable lock-in period, the financial consequences specified in the individual Rent Agreement shall apply.
3.5 Termination Due to Violation
Where occupancy is terminated due to serious misconduct, violation of rules, legal issues, unpaid dues or other contractual breaches, the security deposit may be adjusted or withheld to the extent permitted under the applicable Rent Agreement and applicable law.
4. LOCK-IN & NOTICE PERIOD
The lock-in period and notice period applicable to each tenant shall be as specified in the individual Rent Agreement.
Unless a different period is specifically stated in the individual agreement:
A 3-month lock-in period applies.
A minimum 30-day advance written notice is required before vacating.
Leaving before completion of the lock-in period may result in financial liability for the remaining lock-in period as specified in the agreement.
Failure to provide the required notice may result in security deposit adjustment/forfeiture as provided under the applicable agreement.
5. RENT AGREEMENT & RENEWAL
The individual Rent/Leave & License Agreement governs the specific occupancy, including the applicable rent, deposit, lock-in period, notice period, property address, agreement duration and other contractual terms.
5.1 Agreement Expiry
Occupancy does not automatically renew after expiry of the agreement.
Any renewal shall be subject to availability and mutually agreed rent and terms, and may require execution of a new agreement.
6. KYC & TENANT VERIFICATION
6.1 Mandatory KYC
Completion of Uttam Stay's KYC and verification process is mandatory for all tenants.
6.2 Documents Required
Tenants may be required to provide:
Aadhaar Card
PAN Card
Driving Licence or other valid identity proof
Permanent/native address proof
Employment/organisation ID, joining letter or equivalent employment proof
Recent passport-size photograph
Any other document reasonably required for verification or compliance
6.3 Digital Verification
Uttam Stay may use authorised third-party service providers for digital KYC and verification.
Cooperation with the verification process is mandatory.
6.4 KYC Charges
Where applicable, a one-time KYC verification charge of ₹199/- may be collected as per the applicable property/process.
6.5 KYC Failure
Failure to provide valid documents, refusal to cooperate with verification, or failure to complete required KYC may result in cancellation or termination of occupancy and applicable financial consequences.
6.6 Data Sharing
KYC information may be shared with relevant government, police, regulatory or authorised verification agencies where required for verification, compliance, safety or record-keeping.
7. CARE OF PROPERTY, DAMAGE & MAINTENANCE
7.1 Cleanliness
Tenants are responsible for maintaining cleanliness in their rooms, bathrooms and common areas.
7.2 Damage & Defacement
Destruction, damage, defacement, misuse or negligent use of Uttam Stay property, furniture, fixtures, appliances or other assets is strictly prohibited.
The responsible tenant shall be liable for the applicable repair or replacement cost, excluding normal wear and tear.
7.3 Normal Wear & Tear
Reasonable deterioration resulting from normal and proper use will generally be considered normal wear and tear.
Damage caused by misuse, negligence, intentional acts, improper handling or unauthorised modification may be charged to the responsible tenant.
7.4 Reporting Damage
Any damage, malfunction, leakage, electrical issue, appliance problem or other property issue must be reported to Uttam Stay promptly.
Failure to report a known issue may result in the tenant being held responsible for additional damage caused by such failure, where applicable.
7.5 Move-In Inventory
Items provided at the time of joining, including beds, mattresses, pillows, bedsheets, cupboards, AC units and other property-specific items, are considered handed over for the tenant's use.
Any discrepancy or pre-existing damage should be reported to Uttam Stay promptly after joining.
7.6 Modifications
Drilling holes, installing fixtures, sticking posters or making alterations to walls, furniture or property is not permitted without prior permission from Uttam Stay.
7.7 Common Amenities
Shared amenities such as WiFi, RO water purifier, induction stove, utensils, washing machine, refrigerator, geyser, gym equipment or other facilities shall be used responsibly and only for their intended purpose.
7.8 Personal Use of Common Amenities
Items provided for common use, including iron, induction cooktop and utensils, must remain in their designated/common areas unless specifically permitted otherwise.
8. KEYS & LOCKS
Each tenant is responsible for the keys provided to them.
Loss of keys may result in applicable replacement or lock charges.
Changing locks without prior permission from Uttam Stay is not permitted.
9. FOOD, KITCHEN & HYGIENE
9.1 Food Storage
Food stored in rooms, common areas or refrigerators must be properly covered, wrapped or stored in suitable containers.
Personal food stored in refrigerators should be clearly labelled or identified.
9.2 Non-Vegetarian Food
Storage or consumption of non-vegetarian food, including eggs, is not permitted at properties where such restriction applies.
9.3 Food Waste
Food waste must be disposed of only in designated dustbins.
Food leftovers must not be left in rooms, sinks or open/common areas.
9.4 Kitchen & Utensils
Tenants using kitchens, utensils or common cooking facilities must clean them immediately after use.
9.5 Outside Food
Tenants using common areas or utensils for outside food are responsible for cleaning the utensils and area after use.
9.6 Food Service
Where food-inclusive accommodation is offered, meals will be provided according to the applicable property menu and operational availability.
Menu, meal timings or food arrangements may change due to operational requirements.
10. SMOKING, ALCOHOL, DRUGS, BETTING & GAMBLING
10.1 Drugs
Consumption, possession, distribution or use of illegal drugs within Uttam Stay premises is strictly prohibited.
10.2 Alcohol
Alcohol consumption is subject to the applicable property rules and applicable law.
Where complaints or reasonable concerns arise regarding alcohol use, Uttam Stay may take appropriate action, including verification/testing where legally permissible.
10.3 Smoking
Smoking is prohibited wherever restricted by Uttam Stay/property rules and applicable law.
10.4 Betting & Gambling
Betting, gambling or related activities are not permitted within the premises.
11. BEHAVIOUR, SAFETY & DISCIPLINE
11.1 Respectful Behaviour
Tenants must behave respectfully with other residents, Uttam Stay representatives, housekeeping staff, security personnel, property staff and service providers.
11.2 Harassment
Any form of harassment, intimidation, threatening behaviour or serious misconduct may result in disciplinary action, termination and/or legal proceedings.
11.3 Ragging
Ragging in any form is strictly prohibited.
Serious incidents may be reported to the appropriate legal authorities.
11.4 Fights & Disputes
Tenants must not engage in physical or verbal fights.
Tenants should report disputes to Uttam Stay management instead of engaging in direct confrontation.
Depending on the circumstances, parties involved in serious disputes may face termination or other disciplinary action.
11.5 Parties
Parties and disruptive gatherings are not permitted inside the premises.
11.6 Noise
Loud music, shouting or excessive noise that disturbs roommates, neighbours or the surrounding residential community is not permitted.
11.7 Appropriate Behaviour & Attire
Tenants are expected to maintain appropriate and respectful behaviour and attire in common and outside areas of the premises.
12. VISITORS & ACCESS CONTROL
Visitor rules may differ depending on the property.
Where a property follows a no-visitor policy, no guests are permitted inside the premises.
12.1 Opposite-Gender Visitors
Opposite-gender visitors are not permitted at properties where such restriction applies.
12.2 Family Visitors
Family visits may be restricted depending on the property's accommodation policy.
12.3 Gate & Security
Tenants must not leave the main gate open or otherwise compromise the security of the property.
12.4 Parking
Vehicles must be parked only in designated areas and must not obstruct neighbours, entrances or common access.
12.5 CCTV
CCTV may be installed in permitted/common entry and access areas for security, monitoring and incident investigation.
13. LATE ENTRY
Tenants returning late are responsible for following the property's access and security procedure.
Where required, tenants should coordinate with roommates or follow the applicable gate-access process.
Late entry must be carried out quietly without disturbing other residents.
Uttam Stay shall not be responsible for inconvenience caused by a tenant failing to follow the applicable late-entry procedure.
14. HOUSEKEEPING & ROOM ACCESS
14.1 Housekeeping
Housekeeping and maintenance activities may be carried out according to the planned schedule of the property.
Tenants are required to cooperate with housekeeping and maintenance staff.
14.2 Room Inspection
Uttam Stay or authorised personnel may inspect/access the premises at reasonable times with prior intimation where required under the applicable agreement.
14.3 Emergency Access
In case of an emergency involving safety, fire, water leakage, electrical hazards, suspected serious property damage or any other urgent situation, authorised personnel may enter the room without prior notice where reasonably necessary to protect persons or property.
14.4 Personal Work
Housekeeping staff must not be used for personal work, including washing personal utensils, clothes or other personal tasks.
14.5 Laundry
Tenants are responsible for their own laundry and must use designated washing facilities appropriately.
Tenants are encouraged to use washing machines efficiently and avoid unnecessary part-load operation to reduce electricity and water consumption.
15. ELECTRICITY & UTILITY CHARGES
Depending on the property and city, Uttam Stay may use different electricity and utility billing structures.
15.1 Actual Usage / Pro-Rata Billing
Electricity and applicable consumable charges may be shared among tenants based on actual consumption and applicable billing rules.
Electricity bills may typically be generated every two months.
If a tenant vacates before the actual bill is generated, the applicable amount may be estimated on a pro-rata basis using available billing/consumption data, including previous billing averages where applicable.
The estimated amount may be included in the final settlement and adjusted against the security deposit or separately collected.
15.2 Fixed Monthly Electricity Charge
Some properties may operate under a fixed monthly electricity charge.
The fixed charge is independent of the actual electricity bill and may be revised with prior notice based on consumption, operating costs and other applicable factors.
Revisions may generally occur periodically, including approximately every four months, depending on the property.
15.3 Solar Properties
Where a property has a rooftop solar system, tenants may still be charged based on applicable electricity units consumed.
Solar generation does not automatically eliminate tenant electricity charges.
15.4 Other Utilities & Consumables
Depending on the property, applicable charges for water, gas, maintenance, consumables or other utilities/services may be collected separately according to the property's applicable billing structure.
15.5 Electricity Calculation
The applicable unit rate, charges and calculation method will be determined according to the property's billing structure.
Electricity bill copies or individual calculation sheets may not necessarily be circulated where the applicable billing system uses internal/pro-rata calculations.
16. AC / COOLER CHARGES
For AC-enabled accommodations:
AC electricity consumption may be metered separately.
AC charges are additional to regular electricity charges unless specifically included in the accommodation rent.
AC charges may be calculated according to actual consumption, applicable unit rates and property billing rules.
AC charges may be included in the monthly bill or final settlement.
Where damage or misuse of AC/cooler equipment occurs, applicable repair or replacement costs may be recovered from the responsible tenant.
Where responsibility cannot reasonably be determined and the applicable property policy provides for collective responsibility, the applicable occupants sharing the relevant room may be charged accordingly.
17. INTERNET POLICY
17.1 Speed & Availability
Internet speed and availability depend upon the service provider, network conditions and property location.
Uttam Stay does not guarantee uninterrupted internet service or a specific internet speed, particularly where the issue is caused by the service provider or external network conditions.
17.2 Device & Password Security
Device usage may be subject to reasonable limits.
Tenants must not share WiFi passwords with outsiders.
17.3 Prohibited Usage
Internet use for illegal activities, accessing pornography, creating or maintaining fake accounts, downloading/viewing pirated content, IP spoofing, unauthorised network activity or other prohibited activities is strictly not permitted.
Use of VPNs may also be restricted under the applicable property internet policy.
18. PERSONAL BELONGINGS
Tenants are solely responsible for the safety and security of their personal belongings, including:
Cash
Jewellery
Electronics
Mobile phones
Laptops
Documents
Personal items
Other valuables
Uttam Stay does not accept responsibility for loss or theft of personal belongings except to the extent required under applicable law.
Tenants should keep valuables securely locked.
Housekeeping or maintenance may be carried out even when the tenant is absent. Tenants are therefore advised not to leave valuables unsecured.
19. UNCLAIMED / ABANDONED BELONGINGS
Tenants must remove all personal belongings at the time of vacating.
Any belongings left behind after the tenant has vacated may be handled, stored, removed or disposed of by Uttam Stay in accordance with applicable law and reasonable operational requirements.
Reasonable storage, transportation, handling or disposal costs, where applicable, may be recovered from the tenant.
20. PETS & ANIMALS
Animals and pets are not permitted inside Uttam Stay premises unless expressly permitted in writing for a specific property.
21. POLICE, LEGAL & GOVERNMENT AUTHORITIES
Tenants must comply with applicable laws and rules of government, municipal, police, electricity, water, society and other relevant authorities.
Where reasonably possible, tenants are requested to inform Uttam Stay management before contacting police regarding a property-related matter.
This does not restrict any person's right or obligation to contact emergency services or authorities where required by law or where immediate safety is involved.
Any police complaint, notice, investigation or official engagement concerning the tenant or property should be communicated to Uttam Stay as soon as reasonably possible.
22. USE OF RENT AGREEMENT & PROPERTY ADDRESS
The Rent/Leave & License Agreement and property address are provided solely for the purpose stated in the applicable agreement.
The tenant must not represent themselves as the owner, lessee, principal tenant or independent holder of property rights on the basis of the PG occupancy or agreement.
Unless legally permitted or expressly authorised, the tenant must not use the agreement or property address for obtaining:
Loans
Credit facilities
Financial facilities
Bank/credit facilities
SIM/mobile connections
Business registrations
GST registration
Trade licences
Vehicle registration
Government registrations
Other licences, documents, facilities or services
where such use is not legally permissible or has not been expressly authorised.
Any unauthorised representation, submission, fabrication or misuse of the agreement or property address may constitute a material breach of the occupancy terms and may result in termination and/or legal action.
23. PROPERTY CLOSURE & UNFORESEEN EVENTS
In rare or unforeseen circumstances, including but not limited to:
Government sealing
Municipal action
Court orders
Legal disputes
Society restrictions
Regulatory action
Force majeure
Natural disasters
Other circumstances beyond reasonable control
a property may be required to temporarily suspend operations or close.
In such circumstances:
Uttam Stay will make reasonable efforts to manage the situation.
Tenants may be required to vacate or shift to another accommodation where reasonably possible.
Security deposit settlement/refund may be delayed until access, legal, financial or operational issues are resolved.
Pending electricity, utility, damage, repair, shifting, emergency accommodation or other legitimate charges may be adjusted from the deposit.
Immediate or full refund may not be possible until the relevant circumstances are resolved.
The individual Rent Agreement and applicable law shall govern the parties' rights and obligations in such exceptional circumstances.
24. INTER-PROPERTY SHIFTING
Tenants may request to shift from one Uttam Stay property/bed to another, subject to availability and approval.
24.1 Documentation
The Tenant must complete the applicable Rent Agreement and KYC formalities for the new property.
24.2 Shifting Charge
A fixed ₹399/- Inter-Property Shifting Charge will apply for each inter-property shift.
24.3 Bedding
The Tenant must carry the bedsheet, pillow cover and blanket allotted/provided to them, wherever applicable.
If new bedding is required because the Tenant does not carry the allotted items:
Bedsheet & Pillow Cover: ₹350/-
Blanket: ₹350/-
These charges are additional to the ₹399/- shifting charge.
24.4 Rent During Shifting Month
The higher rent between the existing bed/property and the new bed/property will apply for the entire month in which the shifting takes place.
The shifting date does not result in daily or pro-rata rent adjustment merely because the shift occurs in the middle of the month.
24.5 Higher-Rent Shift
If the new accommodation has higher rent, the Tenant must pay the applicable higher rent and any resulting shortfall in the required security deposit.
24.6 Lower-Rent Shift
If the new accommodation has lower rent, the higher existing rent will continue for the shifting month.
The lower rent will apply from the subsequent billing cycle.
Any excess security deposit will not be refunded or adjusted against the shifting month's rent and will continue to be carried forward against the Tenant's account for the new accommodation.
25. COMPLAINTS & SERVICE REQUESTS
Tenants should report complaints, maintenance issues and interpersonal concerns through the designated Uttam Stay communication channel.
Tenants should avoid direct confrontation with other residents.
Uttam Stay will make reasonable efforts to review and address complaints according to their nature, urgency and the services available at the property.
Resolution timelines may vary depending on the issue, third-party service providers, property conditions and availability of parts/resources.
26. DIGITAL COMMUNICATION & NOTICES
Official announcements, reminders, payment reminders, policy updates and other notices may be communicated through:
WhatsApp
Tenant applications
Email
Digital notice boards
Official Uttam Stay website
Other official communication channels
Tenants are responsible for checking official communications and following applicable instructions.
27. TERMINATION & EVICTION
Uttam Stay may take action, including termination of occupancy, where permitted under the applicable Rent Agreement and applicable law, in circumstances including:
Non-payment of rent or other dues
Serious or repeated violation of property rules
Unauthorised occupants or subletting
Misuse or damage of property
Illegal activities
Harassment or threats
Serious misconduct
Failure to complete mandatory KYC
Unauthorised use of the property or Rent Agreement
Conduct creating serious safety, security or neighbourhood concerns
Any security deposit adjustment arising from termination shall be handled according to the applicable agreement and applicable law.
28. MOVE-OUT & HANDOVER
At the time of vacating, the tenant must:
Clear all outstanding rent and other applicable charges.
Return keys and property-issued items.
Remove all personal belongings.
Hand over the room/bed and provided assets in reasonable condition.
Report pending maintenance/damage issues.
Complete all required move-out formalities.
Final settlement will be processed after applicable rent, utility charges, damages, repairs and other obligations are determined.
29. PROPERTY-SPECIFIC RULES
Individual Uttam Stay properties may have additional rules based on:
Society regulations
Local authority requirements
Property configuration
Food arrangements
Parking availability
Visitor policy
Electricity billing structure
AC/cooler arrangements
Security requirements
Available amenities
Operational requirements
Where a property-specific rule is communicated to the tenant and does not conflict with the applicable Rent Agreement or applicable law, the tenant is expected to comply with it.
30. DISPUTE RESOLUTION & GOVERNING TERMS
The individual Rent/Leave & License Agreement executed between the relevant parties remains the primary contractual document governing the specific occupancy.
These Website Terms & Conditions supplement the applicable Rent Agreement and property-specific rules.
In case of a conflict, the terms of the signed individual agreement and applicable law shall prevail to the extent required.
The parties should first attempt to resolve disputes amicably through communication and negotiation.
Where a dispute cannot be resolved amicably, the dispute resolution and jurisdiction provisions of the applicable Rent Agreement shall apply.
The occupancy and related contractual matters shall be governed by the applicable laws of India.
31. SEVERABILITY
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall continue to remain effective to the extent permitted by applicable law.
32. REGULAR POLICY UPDATES & TENANT ACKNOWLEDGEMENT
Uttam Stay reserves the right to add, modify, remove or update these Terms & Conditions at any time based on operational, safety, security, regulatory, legal, property-management or other legitimate requirements.
Such updates may be made without advance individual intimation to every tenant.
Tenants are therefore strongly advised to check this page regularly throughout their tenancy period and remain aware of the latest applicable Terms & Conditions.
Important Notice Regarding Older Rent Agreements
Some terms, policies or charges currently applicable at Uttam Stay may have been introduced or updated after a tenant's individual Rent Agreement was executed. Therefore, every provision currently applicable to the tenancy may not necessarily appear in an older Rent Agreement.
By signing the Rent Agreement and/or accepting occupancy at Uttam Stay, the Tenant acknowledges and agrees to comply with the latest Terms & Conditions published on this official page, in addition to the terms of the individual Rent Agreement, to the extent permitted by applicable law.
The Tenant's continued stay at Uttam Stay after the publication or communication of updated Terms & Conditions shall constitute acknowledgement of the updated policies, subject to the applicable Rent Agreement and applicable law.
Tenants are responsible for regularly checking this page during their entire tenancy period.
33. FINAL ACKNOWLEDGEMENT
By joining, occupying or continuing to stay at any Uttam Stay accommodation, the Tenant confirms that they have read, understood and agreed to comply with:
1. The applicable Rent/Leave & License Agreement;
2. These Uttam Stay Website Terms & Conditions;
3. Property-specific rules and policies; and
4. Reasonable instructions and updates communicated by Uttam Stay from time to time.
These provisions are intended to ensure a safe, clean, disciplined and comfortable environment for all Uttam Stay residents.
